Date(s) of entry into Force/provisional-application: In accordance with Article 5 on Entry into Force of the First Protocol to Amend the Agreement Establishing the AANZFTA: - 1 October 2015 for Australia, Brunei Darussalam, Myanmar, New Zealand, the Philippines, Singapore, and Viet Nam. - 2 October 2015 for Thailand. - 9 December 2015 for Malaysia. - 15 December 2015 for Lao PDR. - 11 January 2016 for Cambodia. - 1 March 2019 for Indonesia. Brief description of the changes: The First Protocol streamlines the AANZFTA's rules and does not introduce new market access commitments. Key amendments introduced by the Protocol include: - Modification of the Rules of Origin: Simplification of the Product Specific Rules (PSRs) by consolidating them into a single, comprehensive list and updating them to the Harmonized System (HS) 2012 nomenclature. - Streamlining of Certification Procedures: Update the Operational Certification Procedures for the Rules of Origin of the Agreement to make it more trade facilitative, including but not limited to the removal of the requirement to reflect the FOB value in the Certificate of Origin in cases where the regional value content criteria is not used. - Establishment of procedures to expedite future transpositions of the tariff commitments to be in line with HS Code amendments: These include timely circulation of a draft schedule with detailed two-way concordance at the national tariff line level, opportunities for comments and consultations, timely public release, and consideration of technical assistance.
